Contravening Traffic Signs - Motoring Offence
Failing to comply with the indication given by a traffic sign, whether it be a road marking, sign or a light, is an offence.
Prosecution will largely depend on camera evidence where the offence alleged is failing to comply with red light. Amongst other things, the Prosecution must prove that the camera was correctly calibrated and operated. Any prosecution in relation to road signs will depend largely on eye-witness evidence and accounts from trained police officers. Expert cross examination will therefore be required to successfully challenge an allegation. We are also able to mount technical challenges by considering the legality of the sign, its size and its siting.
Failing to comply with certain signs are endorseable and may also attract a disqualification at the Court’s discretion. We will advise you what penalty you will be likely to receive on conviction.
The regulations detailing traffic sign violations are extremely complex. There are many exceptions to the offences and there are a number of technical ways in which the case against you may be challenged.
