Case Study- Drink driving

Mr R was charged with an offence of excess alcohol.

We attended the first appearance with Mr R who had intended to plead guilty following poor advice from another firm.

However upon looking at the prosecution evidence it was apparent that the intoximeter was faulty and despite a very high reading the case was immediately dropped following representations by us.

This was a classic case of a defence being identified as a result of our expertise and one that went unnoticed by a general criminal practitioner.

As our challenge to the reliability of the intoximeter was successful, Mr R was able to recover the majority of the fees he paid for our representation.
