Reopening Convictions and Sentences
Where you are alleged to have committed an offence, you should have advance notice and ample opportunity to prepare your defence. However, the reality is that sometimes Summonses do not reach the intended recipient. This may be due to circumstances beyond your control such as poor Court administration or an incorrect address being used for service of the Summons. Where a Summons is not contested, or responded to, you will be convicted in your absence. However, there is a legal provision that allows you to request that the Court reverses this.
Where you have been convicted and sentenced in your absence it is important that you seek legal advice as a matter of urgency. The earlier you act the better! If a successful application were made the conviction and sentence would be reversed and you would then be in a position to plead not guilty and defend the offence alleged against you.
