FIVE YEARS FOR SENDING A TEXT WHILST DRIVING

New Legislation which came out on the 18th August 2008 means that drivers who kill whilst avoidably distracted face up to five years in custody. The previous maximum sentence for causing death by careless driving was a fine and penalty points.

Avoidable distractions which the Courts can consider when sentencing motorists who have caused death can include; mobile phone usage, eating and drinking, applying makeup – in fact any distraction that takes the drivers attention away from the road and which was avoidable.
